Terms of Service

1. Parties & Scope

These Terms of Service ("TOS") govern your subscription on the PegasusServe landing page and, in future, your use of the PegasusServe SaaS platform. "PegasusServe," "we" or "us" refers to PegasusServe S.A.S.; "you" or "Subscriber" refers to anyone who provides an email address or uses the platform.

2. Acceptance of Terms

By submitting your email on our landing page, you agree to these TOS in full. If you do not agree, please do not subscribe or use our services.

3. Landing-Page Subscription

• Data Collected: we only collect your email address.
• Purpose: to notify you of product launch and occasional service updates.
• Restrictions: your email will not be used for third-party marketing and will not be shared except with our email delivery processors under confidentiality agreements.

4. Future Platform Access

Once the full PegasusServe platform is available, you will register with an email and password. At that point, additional terms (billing, usage limits, service-level commitments) will apply, and these TOS will govern all SaaS features (VPS orchestration, domain and port management, GitHub integration, etc.).

5. User Responsibilities

You agree not to use PegasusServe for any unlawful or abusive activity, including but not limited to:

• Distributing malware, spam, or engaging in cyber-attacks
• Violating intellectual property rights or applicable law
• Attempting unauthorized access to other users' accounts or servers

6. Intellectual Property

All PegasusServe content software, designs, trademarks remains our exclusive property. You receive a limited, non-exclusive, revocable license to use the service as described herein.

7. Service Availability & Changes

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features or the entire service, providing reasonable advance notice where feasible.

8. Disclaimer of Warranties

The service is provided "as-is" and "as-available." PegasusServe disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, PegasusServe's total liability for claims related to these TOS or the service will not exceed the total fees you have paid in the six months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

You may unsubscribe at any time via the link in our notifications. We may remove your email and suspend notifications if you breach these TOS.

11. Changes to These TOS

We may update these terms; changes will be posted here with a revised "Last updated" date. Continued use of subscription or platform services constitutes acceptance of the updated TOS.

12. Governing Law & Jurisdiction

These TOS are governed by Peruvian law. Any dispute arising under these terms will be subject to the exclusive jurisdiction of the courts in Lima, Peru.
